The below booking conditions form part of the contract between the Safari participant(s) or Safari sponsor accepting on behalf of all Travelers referred to below as ‘you’, your’, ‘the client’, ‘Traveler’, ‘customer’, or ‘guest’ and Kili Serengeti Guides,(limited liability corporation), a registered seller of Safari in The United Republic of Tanzania (referred to below as ‘Kili Serengeti Guides, ‘Kili Serengeti Guides, ‘we’, ‘us’ and ‘our’) for all quotations received or Safari arrangements reserved for Tanzania or East Africa in general.
BOOKING CONDITION
Prices are subject to change without any prior indication due to increase in airfares, transport, hotel rates, exchange rates, government tax etc.Kili Serengeti Guides reserves the right to cover increased costs, tariffs & taxes and to reflect fluctuations in foreign exchange markets. For all reservations made over 3moths prior to departure, a deposit of 50% of the total per person trip cost as outlined in your itinerary is required at the time of reservation. Full payment is required 90 days prior to departure from your home city. Kili Serengeti Guides reserves the right to cancel bookings for which full payment has not been received 90 days prior to departure, a deposit of 50% of the total per

CANCELLATION POLICY
Cancellations received up to 90 days prior to departure will be subject to a cancellation charge of 30% of the per person trip cost per booking. Cancellations received less than 90 days prior to departure will be subject to the following forfeit of tour cost:
up to 90 days – 30% of trip cost
60 to 46 days – 50% of trip cost
45 to 0 days – 50% of trip cost
LIMITATION OF LIABILITY
The client understands that Kili Serengeti Guides. Is not the source but 50% a supplying agent of the Safari services requested, and acts solely as an agent for the actual suppliers of such services. Client is advised that the suppliers whose names appear in the itinerary information supplied (such as hotels and airlines) are those who are actually responsible for providing the Safari services purchased. Client consents to and requests the use of those suppliers and agrees not to hold Kili Serengeti Guides fully responsible, In case any of these suppliers: i.) Fail to provide the services purchased; ii.) Fail to comply with any applicable law; or iii.) Engage in any negligent act or omission that causes any sort of injury, damage, delay or inconvenience.
Client accepts that Kili Serengeti Guides. Is not responsible for, nor will client attempt to hold it liable for, any injury, damage or loss suffered by Travelers on account of any conditions, actions or omissions that are beyond its reasonable control. Client will review Safari documents for accuracy upon receipt and understand that they may contact Kili Serengeti Guides if they have any questions.
AWARENESS & DISCOUNT
Client understands that discounted fares typically involve restrictions and that changing any aspect of Safari arrangements may result in the payment of additional money. Client understands that if Safariing internationally, all Travelers must have a valid passport and depending upon their destination and nationality, client may need to obtain one or more visas. Passport and visa information may be obtained by contacting the Safari advisory section of the generating State department at or by visiting their state department’s web site. Passport holders should be sure to contact the embassies of their destination and transit countries to obtain entrance requirements.
REFUND FOR UNUSED SERVICES
No refund or exchange can be made in respect to accommodation, meals, sightseeing tours, transport or any other services, which are included in the Safari package rate but not utilized by the Traveler.
Tanzania law requires sellers of Safari to have a trust account or bond. Kili Serengeti Guides Has a trust account. Upon cancellation of the transportation, or Safari services, where the Traveler is not at fault and has not canceled in violation of any terms and conditions previously clearly and conspicuously disclosed and agreed to by the customer, all sums paid to the seller of Safari for services not provided will be promptly paid to the customer, unless the customer advises the seller of Safari in writing, after cancellation. This provision does not apply where the seller of Safari has remitted the payment to another registered wholesale seller of Safari or a carrier, without obtaining a refund, and where the wholesaler or provider defaults in providing the agreed-upon transportation or service. In this situation, the seller of Safari must provide the customer with a written statement accompanied by bank records establishing the disbursement of the payment, and if disbursed to a wholesale seller of Holiday packages, proof of current registration of that wholesaler.
This transaction is covered by the Tanzania Tourist Board for consumer restitution fund (TTB) if the seller of Safari was registered and participating in the TTB at the time of sale and the customer is located in Tanzania at the time of payment. Eligible customers may file a claim with Kili Serengeti Guides or TTB if the customer is owed a refund of more than $50 for transportation or Safari services which the seller of Safari failed to forward to a proper provider or such money was not refunded to you when required. The maximum amount which may be paid by the TTB to any one customer is the total amount paid on behalf of the customer to the seller of Safari, not to exceed $15,000.
A claim must be submitted to the (Kili Serengeti Guides and a copy to Tanzania Tourist Board) TTB within six months after the scheduled completion date of Safari. A claim must include sufficient documentation to prove your claim and a $30 processing fee. Claimants must agree to waive their right to other civil remedies against a registered participating seller of Safari for matters arising out of sale for which you file a claim.
For customers purchasing from outside of Tanzania this transaction is not covered by the Tanzania Tourist Board Safari consumer restitution fund.
TRANSPORTATION
The airlines & other carriers concerned provide transport timings. They are subject to change as a result of air traffic control restrictions, weather conditions, operational/maintenance requirements & the requirement for customers to check in on time. Kili Serengeti Guidess cannot be held responsible for if there is any change to a departure or arrival time shown in their website, tours or on any ticket. Similarly, we cannot make any special arrangements for you if you are delayed since such matters are at the sole discretion of the airline or any other carrier concerned.
We recommend that you take the following Safari insurances prior to your departure:
Trip cancellation and interruption (must cover our cancellation terms as listed in section 1)
Baggage delay, loss & pilferage
Medical & emergency evacuation
Accidental death & disability
PARTICIPATION
Please ensure that you take all appropriate medical advice prior to departure as to whether or not you are fit enough to take the trip booked. Persons not fit for long trips due to age, disease, chronic illness, physical handicap, advance pregnancy or mental illness should not participate in these rigorous Safari programs. Please consult your physician for advice on the appropriate malaria prophylactics available prior to departure. Please note Kili Serengeti Guides is unable to provide advice or suggestions on malaria prophylactics and whether or not they would be advisable based on your medical history. To obtain medical information, you may contact the centers for disease control in your country or Client understands that they may purchase Safari insurance to cover certain risks inherent in Safari such as supplier bankruptcy and the inability to Safari due to a m.
RISKS & INDEMNITY
Kili Serengeti Guides draws your attention to the fact that there are certain inherent risks involved in participating in the type of trips sold by Kili Serengeti Guides and that you accept them at your own risk. Safaris involve close encounters with wild animals during game activities as well during stays at camps/lodges as all properties remain unfenced so as not to disrupt animal migratory patterns. Travelers are advised to follow the advice and guidance of the camp managers and game rangers while on safari and practice all safety procedures outlined. All Travelers acknowledge that they are fully aware of and appreciate the dangers and risks that are associated with game reserves and/or game lodges arising from the presence of wild and dangerous animals, reptiles, birds and insects and the risk of suffering bodily harm, injury, death and/or loss which may arise as a result of an encounter with and/or the presence of wild animals and/or reptiles and/or birds whilst on safari. medical or personal emergency.
FORCE MAJEURE
This means, in relation to Kili Serengeti Guides, any circumstances beyond the reasonable control of Kili Serengeti Guides [including but without limitation, acts of nature, explosion, flood, tempest, fire, accident, war or threat of war, sabotage, terrorism, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions or other untoward occurrences. If Kili Serengeti Guides is affected by force majeure it shall notify you of the nature and extent thereof. Kili Serengeti Guides shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance or by non performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any force majeure.
AIRLINE CLAUSE
Airlines are not to be held responsible for any act, omission, or event during the time customers are not onboard their planes or conveyances. International air carriers are also subject to international air conventions limiting their liability. These limitations are explained on the reverse side of the airline ticket which, when issued, constitutes the sole contract between the airlines and their customers.
FLIGHT CONFIRMATIONS
Please re-confirm your onward flights with the outgoing carrier at least 72 hours prior to departure.
SPECIAL REQUESTS
Your special request (e.g. Diet, particular room, seating etc.) Should be put in writing.
We shall forward it to our suppliers, however no special request can be guaranteed.
SAFARI DOCUMENTS
It is the sole responsibility of the customer to ensure that his/her Safari documents, visa, inoculations etc. Are in order prior to departure. Kili Serengeti Guides not liable if you fail to have the required documents.
ALTERATIONS & DELAYS
Although unlikely, we may occasionally have to change or cancel your Safari arrangements and we reserve the right to do so at any time. This could be due to prevailing conditions or unforeseen circumstances. Kili Serengeti Guides does not hold itself liable for delays prior to departure or during the course of any Safari, whether brought about by unforeseen contingency or other causes beyond our control. ALTERATIONS & DELAYS
LUGGAGE ON KILIMANJARO
Luggage is restricted to 20kg maximum per and only soft duffel bags will be accepted (no hard suitcases / attaches can be recommended on climb as they physically cannot fit in climbing requirement. Weight allowance includes camera equipment, body cream, snacks, water, trekking wares, walking sticks and hand luggage, etc
CUSTOMER WEIGHT ON AIR CRAFT
All customers weighing 100kg (220 lbs) or more but must advise us in advance as an extra seat will then have to be costed into the package for aircraft configuration and customer safety purposes.
CONSENT
The advance payment or any other partial payment for a reservation on a Safari package constitutes consent to all provisions of this contract. The terms under which you agree to take these Safari services cannot be changed or amended except in writing signed by our customer and proved by our authorized officer of guided safaris.
RESPONSIBILITIES
The right is reserved to alter or modify itineraries or hotel accommodation in any way necessary, but with a notice in the interest of the tour members. Kili Serengeti Guides act only as a booking agent for various Hotels and other safari relative companies and has no liability whatsoever for any aspect of the arrangements and, in any particular source, has no responsibility for any death, personal injury, delay, damage, accident or loss of whatever nature you may suffer. There will be no compensation from changes or cancellation if the same are due to natural disasters, civil disturbances, quarantine etc. Of which we have no control. Kili Serengeti Guides is not liable for any act of omission, default or defect of themselves, their employees and agents, for any loss, damage or injury to persons or goods however they may be caused and also for the accuracy of any information forwarded by the Safari services of their agents.
You hereby declare that you have fully read, understood and accept the above booking conditions on behalf of all Travelers accompanying you on this trip. Note: any Traveler who signs this service contract on behalf of any other Traveler participating in the same trip warrants to Kili Serengeti Guides.
